ESIGN Consent to Electronic Disclosures and Signatures
 

We are required by law to give you certain information “in writing” – which means you are entitled to receive it on paper. We need your consent to give you this information electronically instead and to use electronic records and signatures in our relationship with you. “Communications” means each disclosure, notice, agreement, pricing schedule, periodic statement, record, document or other information we provide to you, or that you sign or submit or agree to at our request. Communications will be provided on our website as part of the application process, through your online/mobile account, and/or through email.

We may always, in our sole discretion, provide you with any Communications on paper, even if you have authorized electronic delivery.

For purposes of this consent the terms "you" and "your" refer to the applicant and any other person who is also contractually liable under the Cardmember Agreement. Additionally, "we," "us," "our" refer to First Bank & Trust, including any successor or assign, and its service providers. Capitalized terms have the same meaning as defined in the Cardmember Agreement.

Your ESIGN Consent

You agree that any of the Communications we provide to you, that you sign, or that you agree to, at our request, may be in electronic form. We may also use electronic signatures and obtain them from you on any Communications. You agree you intend as your electronic signature any name or mark you provide to us in response to our request for an electronic signature. Your consent will apply to this transaction and all documents related to this transaction, as well as all future transactions with us.

You must elect whether to receive your periodic statements in paper or paperless form. If you do not elect to receive paperless statements, we will send you paper statements, and you will be charged a monthly paper statement fee.

Maintaining an Up-to-Date Email Address

Because this consent will apply to future Communications, it is important that you keep your account profile up to date with us. The email address in your account profile must be current for you to receive any notifications or Communications by email that we may send you. If you need to update the information needed to contact you electronically, you may do so by contacting Customer Service at 866-686-2158.

Requesting Paper Copies of Electronic Communications

If, after you consent to receive electronic Communications, you would like a paper copy of a Communication we previously sent you electronically, you may request a paper copy by calling us at 866-686-2158, or writing to Attn: Card Services, PO Box 84064, Columbus, GA 31908. Requests for paper copies must be made within a reasonable time after we first provided the electronic Communication to you. If you do not elect to receive paperless periodic statements, a fee will be charged each month for mailed paper statements. In addition, if you request a duplicate paper copy of any Communication (including a duplicate paper copy of a periodic statement for any purpose other than to assert a billing error), we may charge you a fee for each duplicate copy requested. (See your Cardmember Agreement for details.) We will send your paper copy to you by U.S. mail. In order for us to send you paper copies, you must have a current address on file in your account profile.

Hardware and Software Requirements

To access and retain electronic Communications, you will need:

. An Internet connection;

.A Current Version (defined below) of Edge, Chrome, Safari, Firefox or Samsung Internet;

.A Current Version of a program that accurately reads and displays PDF files;

.A valid email address (your primary email address in your account profile);

.A computer, tablet or mobile phone and an operating system capable of supporting all of the above; and

.Sufficient storage space to save past Communications or an installed printer to print them.

"Current Version" means a version of the software that is currently being supported by its publisher. From time to time, we may offer services or features that require that your Internet browser be configured in a particular way, such as permitting the use of JavaScript, cookies or local storage. We may also require you to use a Current Version of one or more specific software applications we may specify from time to time. We reserve the right to discontinue support of a Current Version of any software if, in our sole judgment, it suffers from a security flaw or other flaw that makes it unsuitable for use. By consenting, you are confirming that you meet the hardware and software provided for above.

We will notify you if there are any material changes to the hardware or software needed to receive electronic Communications from us. Continuing to access your Account after receiving notice of the change is reaffirmation of your consent.

How to Withdraw your Consent

You may withdraw your consent to receive electronic Communications by writing to: Attn: Card Services, PO Box 84064, Columbus, GA 31908. If you withdraw your consent to receive electronic Communications, we reserve the right to either deny your application for an Account, restrict or deactivate your Account, or close your Account. A withdrawal of your consent to receive electronic Communications will be effective only after we have had a reasonable period of time to process your withdrawal. If you do not elect to receive paperless statements, we will provide your periodic statement to you in paper form but your consent to receive electronic Communications will otherwise remain in effect.

Retaining Copies

We encourage you to print or download for your records a copy of all electronic Communications as well as this ESIGN Consent disclosure and any other document.

Termination and Changes

We reserve the right, in our sole discretion, to discontinue the provision of your electronic Communications, or to terminate or change the terms and conditions on which we provide electronic Communications. We will provide you with notice of any such termination or change as required by law.
