NY Residents - For questions, call us at 866-686-2158. New York residents may contact the New York state department of financial services by calling (800) 342-3736 or by visiting its website, www.dfs.ny.gov, for free information on comparative credit card rates, fees and grace periods.

CA Residents - If you are married, you may apply for a separate account.

OH Residents - The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.

WI Residents - No marital property agreement, unilateral statement, or court decree adversely affects our rights, unless you give us a copy of such agreement, statement or court order before we grant you credit, or we have actual knowledge of its terms before your account is opened. If you are married, by submitting your application you are confirming that this credit card application is being incurred in the interest of your marriage and your family.

Identity Verification - IMPORTANT INFORMATION ABOUT PROCEDURES FOR OPENING A NEW ACCOUNT To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents; and obtain identification information about you or any authorized user you add to your account.

Credit Reports - We may order credit reports in connection with processing applications/solicitations and any update, renewal or extension of credit. Upon request, we will tell you the name and address of any consumer reporting agency that furnished a report on you. You consent to the obtaining of such reports by signing or otherwise submitting an application or solicitation.

About This Offer - This offer is valid for new accounts only. You must be at least 18 years of age or 21 years of age if you are a permanent resident of Puerto Rico. Applicants must have a permanent residential address in the 50 United States, District of Columbia, Puerto Rico, or have a United States military address. If at the time of your application you do not meet the credit or income criteria previously established for this offer, or the income you report is insufficient based on your current obligations, we may be unable to open an account for you. Additional fees and account terms will be described in the Cardmember Agreement that will be provided with the card upon approval. Upon approval, you will receive a Cardmember Agreement. You agree that the Cardmember Agreement and the account are governed by South Dakota and federal law. The terms of your account, including rates and fees, are subject to change, to the extent permitted by law.

How Variable Rates are Calculated - We calculate variable rates by adding a percentage to the Prime Rate published in the Money Rates section of The Wall Street Journal on the last business day of the month. For the purchase and balance transfer APR, we add 21.49% to the Prime Rate. For the cash advance APR, we add 21.49% to the Prime Rate. You authorize us to round interest charges to the nearest cent. See your Cardmember Agreement for more detail. The variable APRs noted above are based on the Prime Rate of 8.5% as of March 29, 2024. Any increase in the Prime Rate may increase your Interest Charges and your Minimum Payment Due.

Credit Line - Applicants may not request a specific credit line. We determine your credit line based on a review of information bearing on your creditworthiness.

Payment Allocation - Payment for up to the Minimum Payment Due amount will be applied at our discretion, and may be applied first to fees and interest, then to the balance with the lowest APR on your Account, and then to balances with higher APRs. Payment amounts in excess of the Minimum Payment Due will first be applied to the balances with the higher APRs before balances with lower APRs, except as otherwise required by applicable law. Credits will be applied at our discretion.

Telephone Number - Permission to Contact - By giving us your telephone number, you authorize us and our service providers to contact you at that number regarding your account. Your consent allows contact by text messaging, artificial or prerecorded voice messages and automatic dialing technology for periodic informational and service calls or texts, but not for telemarketing or sales calls or texts. These communications may be monitored or recorded. Message and data rates may apply. You can opt out of text messaging by responding “STOP”. You can change these preferences at any time by contacting us. If you have any questions regarding privacy, please read our Privacy Notice.

Consent to Allow us to Access Your Mobile Subscriber Details - You authorize your wireless operator (AT&T, Sprint, T-Mobile, US Cellular, Verizon, or any other branded wireless operator) to use your mobile number, name, address, email, network status, customer type, customer role, billing type, mobile device identifiers (IMSI and IMEI) and other subscriber status details, if available, solely to allow verification of your identity and to compare information you provided with your wireless operator account profile information for the duration of the business relationship. For more information on how we treat your data, please visit “Privacy” on www.mercurycards.com.

Jury Trial Waiver and Arbitration - The Cardmember Agreement contains a Jury Trial Waiver and Arbitration Clause, which impacts your rights, including your right to bring or participate in a class action or have a jury trial in the event of a Dispute between you and us. You may reject the Jury Trial Waiver and Arbitration Clause for your new account by following the steps noted in that section of the Cardmember Agreement within 60 days after you have accepted the Agreement.
